Terms of Use

These terms are an agreement between you and BasketPal (“BasketPal”, “we”, “us”) for your use of the BasketPal app and website (the “Service”). By creating an account, signing in, or using the Service, you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

1. The Service

BasketPal keeps a running total of your shopping as you add items, including by voice. It is a personal budgeting aid. It is not a store, doesn’t sell groceries or process payments at the checkout, and isn’t affiliated with any retailer.

Totals are only as accurate as the items and prices recorded. Voice recognition and our AI features can mishear or misread what you say, so always check your basket and the price you pay at the checkout. You remain responsible for your purchases and your budget.

2. Your account

You must be at least 16 years old, or the age of digital consent where you live if higher, to use the Service. Give us accurate information, keep your sign-in details secure, and tell us promptly at hello@basketpal.app if you think your account has been used without your permission. You are responsible for activity on your account.

3. Subscriptions

• Using BasketPal requires a BasketPal Plus subscription, offered monthly or yearly at the price shown in the app before you buy.
• Subscriptions are bought through the Apple App Store or Google Play and billed to that account. They renew automatically at the end of each period unless you cancel at least 24 hours before it ends.
• If a free trial is offered, you are charged when it ends unless you cancel before then.
• You can manage or cancel your subscription in your App Store or Google Play account settings. Cancelling stops future renewals; you keep access until the end of the period you paid for.
• Refunds are handled by Apple or Google under their policies. This doesn’t affect any rights you have under consumer law.
• If we change the price, we will tell you in advance, and the change will apply from your next renewal as required by Apple or Google.

4. Acceptable use

Don’t:

• use the Service unlawfully, or to harm or harass others;
• try to access other people’s accounts or data, or our systems without permission;
• interfere with the Service, overload it, or get around usage limits;
• reverse engineer, copy or resell the Service, except where the law allows it;
• use the voice feature to send content unrelated to shopping in order to misuse our AI provider.

5. Your content

The items, prices and other information you add remain yours. You allow us to process them only to provide the Service to you, as described in our Privacy Policy.

6. Our rights

The Service, including its software, design and brand, belongs to BasketPal and its licensors. We grant you a personal, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, while you follow these terms.

7. Third-party services

Some features rely on others, such as Apple, Google and Telegram for sign-in, your phone’s speech recognition, and app store billing. Their own terms apply to your use of them, and we aren’t responsible for them.

8. Changes and availability

We work to keep the Service available and improving, but we may change, suspend or discontinue features. If we make changes to these terms that materially affect you, we will tell you in the app before they apply. If you keep using the Service after that, the new terms apply.

9. Ending your use

You can stop using the Service at any time and ask us to delete your account at hello@basketpal.app. Deleting your account doesn’t cancel an App Store or Google Play subscription; cancel it in your store settings. We may suspend or close accounts that seriously or repeatedly break these terms.

10. Disclaimers

To the extent the law allows, the Service is provided “as is”. We don’t promise that it will be error-free or uninterrupted, or that totals, prices or AI results will always be accurate.

11. Liability

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer. Subject to that, we are not liable for losses that were not foreseeable, for business losses, or for amounts spent on purchases based on totals shown in the app, and our total liability to you is limited to the amount you paid for the Service in the 12 months before the claim.

12. Apple App Store terms

If you downloaded BasketPal from the Apple App Store, these additional terms apply:

• These terms are between you and BasketPal, not Apple. BasketPal, not Apple, is responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the app.
• BasketPal, not Apple, is responsible for handling any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims the app infringes their intellectual property rights, BasketPal, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. General

If any part of these terms is found unenforceable, the rest stays in effect. If we don’t enforce a term straight away, we can still enforce it later. You may not transfer your rights under these terms without our consent. Mandatory consumer protection laws of the country where you live continue to apply to you.
